1. Acceptance of Terms
By accessing or using this website and the AutoFilm-powered pages where you view videos, inspections, and messages (the "Services") operated by AutoCurb LLC (d/b/a AutoFilm; "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Services.
These Terms are between you and the participating motor-vehicle dealership ("Dealer") that sent the video, inspection, or message to you. The Dealer operates the Services through AutoFilm, a technology platform that acts solely as the Dealer's service provider and facilitator. The Dealer — not AutoFilm — is the party you are transacting with and is responsible for the offers, prices, recommendations, and communications you receive. Dealer subscriptions are governed by separate Dealer Subscription Terms.
2. Services
AutoFilm provides an online platform for personal video messaging, multi-point vehicle inspections, service approvals, appointment scheduling, and related dealership communications. Unless a value is expressly labeled a "firm price" or "firm offer," any recommended service, price, trade value, or estimate you see through the Services is an estimate only — it is not a binding offer, is not a guarantee of price, and creates no obligation on you or the Dealer. Where the Dealer expressly presents a value as firm, the Dealer commits to honoring that amount for the stated validity period provided an in-person inspection confirms the vehicle matches your description; if inspection reveals something materially different, the Dealer is not bound by that amount. Every value is conditioned on in-person inspection and verification of the vehicle's actual condition, mileage, equipment, title, and history, and may be revised upward or downward or withdrawn. No purchase or service obligation exists on either party unless and until a written agreement (or a documented in-app approval) is completed by both parties.
3. User Submissions
When you submit information through the Services (including contact information, vehicle details, photographs, videos, or approvals of recommended work), you represent that the information provided is accurate and that you are authorized to submit it. You retain ownership of any content you upload but grant the Dealer and AutoFilm a non-exclusive license to use it to deliver the Services to you.
4. Text Messaging Program Terms (SMS/MMS)
Dealer Video, Inspection & Appointment Alerts (powered by AutoFilm)
This program sends transactional and customer-care text messages about the video, inspection, or vehicle you are working with: a link to view or reply to a personal video, a link to review and approve recommended service work, appointment and pickup confirmations and reminders, one-time verification codes, and occasional follow-ups. By providing your contact information and mobile number to a Dealer through any AutoFilm form or intake, you consent to receive these recurring automated and prerecorded SMS/MMS messages from the Dealer, sent through its technology provider, AutoFilm. Consent is not a condition of any purchase.
You can cancel the SMS service at any time. Just reply STOP to any message from us. After you send STOP, we will send a one-time message to confirm that you have been unsubscribed, after which you will no longer receive SMS messages from us. If you want to join again, simply sign up again the way you did the first time and we will resume sending messages to you.

Carriers are not liable for delayed or undelivered messages.
As always, message and data rates may apply for any messages sent to you from us and to us from you. You will receive up to 10 messages per month; message frequency varies depending on your interaction with the Services. If you have any questions about your text or data plan, it is best to contact your wireless provider.
If you have any questions regarding privacy, please read our Privacy Policy. We do not sell or share your mobile number or opt-in consent with third parties or affiliates for marketing or promotional purposes.
5. Price & Estimate Validity
Prices and estimates shown through the Services are valid for the period stated by the Dealer (typically up to 8 calendar days from the date of issuance) and are subject to in-person inspection confirming the accuracy of the information provided. Material discrepancies between the submitted information and the actual vehicle condition may result in an adjusted price or estimate.
6. Disclaimer of Warranties; Limitation of Liability
THE WEBSITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, AUTOCURB LLC DISCLAIMS ALL EXPRESS AND IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.
To the fullest extent permitted by law, AutoCurb LLC shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of the Services or any estimate, including any claim that you declined or forfeited another offer or service in reliance on an estimate. AutoCurb LLC's total liability shall not exceed the final purchase or service amount stated in a signed agreement, if any.
7. Acceptable Use & Intellectual Property
You agree not to submit false, fraudulent, or another person's information; misrepresent a vehicle's condition, mileage, title, or ownership; use the Services unlawfully; or attempt to disrupt, scrape, or gain unauthorized access to the Services. The website, its content, and the underlying software platform (including AutoFilm branding) are owned by AutoCurb LLC or its technology providers; videos and inspection content are owned by the Dealer that created them. You receive only a limited, revocable license to use the Services for your personal vehicle transaction.
8. Electronic Communications (E-SIGN)
By using the Services you consent to receive communications electronically and agree that electronic agreements, notices, approvals, and records satisfy any legal requirement that they be in writing.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Connecticut, without regard to its conflict of law provisions.
